By accessing or using Stable Commerce ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Stable Commerce is an AI-powered platform that builds and runs an ecommerce store on your behalf. Depending on your plan, the Service includes:

To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

The Service and its original content, features, and functionality are owned by Stable Commerce and are protected by international copyright, trademark, and other intellectual property laws.
You own your store content, product data, and customer lists. By using our Service, you grant us a license to use, modify, and display your content solely for the purpose of providing our Service.
Content our AI generates for your store — including product descriptions, page copy, emails, and ad creative — is yours to use commercially as part of operating your store. You may not resell or redistribute AI-generated content as a standalone product outside your store without our permission.
Paid plans are billed monthly in advance. Some plans also include a per-transaction fee on sales made through your store. Current plans, prices, and fees are listed at stablecommerce.ai/pricing and may include monthly limits on AI-driven tasks. Fees are non-refundable except as required by law or as specified in our refund policy.
Subscription fees and store transaction payments are processed by Stripe. Payments from your store's customers are processed through your own linked Stripe account and settle directly to your linked bank account — Stable Commerce is not the merchant of record for your store's sales and does not hold or store your customers' payment information.
We may change our pricing with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.
Depending on the features you use, the Service connects to third-party platforms on your behalf, including Stripe for payments and payouts, Meta (Facebook/Instagram) and Google for advertising, and email delivery and domain/DNS providers for your store. Your use of these connected platforms is also subject to their own terms of service. We are not responsible for outages, account suspensions, or ad spend charged directly by these third-party platforms.
Our AI agents can take actions on your store automatically, such as publishing content, adjusting prices, managing ad campaigns and budgets, and sending marketing emails. AI output may contain errors, and you are responsible for reviewing agent actions before or shortly after they take effect. You can pause or restrict automation for your store at any time through your account settings. We do not guarantee any specific level of sales, search ranking, or advertising performance from using the Service.
You are the seller of record for your store. You are responsible for the legality of the products you sell, product descriptions and claims, applicable taxes, shipping and fulfillment, refunds and returns, and resolving disputes with your customers.
If you participate in our affiliate program, that participation is governed by the separate affiliate terms available at affiliates.stablecommerce.ai, in addition to these Terms.
We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or technical issues.
To the maximum extent permitted by law, Stable Commerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
You agree to indemnify and hold harmless Stable Commerce from any claims, damages, or expenses arising from your use of the Service, your store's content or sales, or your violation of these Terms.
You may terminate your account at any time by contacting our support team. Upon termination, your access to the Service will cease, and your store will be taken offline. You may request an export of your store data for a limited period after cancellation before it is deleted.
We may terminate or suspend your account immediately if you violate these Terms or engage in conduct that we determine is harmful to our Service or other users.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Our registered address is 131 Continental Dr, Suite 305, Newark, County of New Castle, Delaware 19713.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
